Monetary intelligence theory asserts that individuals apply their money attitude to frame critical concerns in the context and strategically select certain options to achieve financial goals and ultimate happiness. This study explores the dark side of monetary Intelligence and behavioral economics—dishonesty. Dishonesty, a risky prospect, involves cost–benefit analysis of self-interest. We frame good or bad barrels in the environmental context as a proxy of high or low probability of getting caught for dishonesty, respectively. We theorize: The magnitude and intensity of (...) the relationship between love of money and dishonest prospect may reveal how individuals frame dishonesty in the context of two levels of subjective norm—perceived corporate ethical values at the micro-level and Corruption Perceptions Index at the macro-level, collected from multiple sources. Based on 6382 managers in 31 geopolitical entities across six continents, our cross-level three-way interaction effect illustrates: As expected, managers in good barrels, mixed barrels, and bad barrels display low, medium, and high magnitude of dishonesty, respectively. With high CEV, the intensity is the same across cultures. With low CEV, the intensity of dishonesty is the highest in high CPI entities —the Enron Effect, but the lowest in low CPI entities. CPI has a strong impact on the magnitude of dishonesty, whereas CEV has a strong impact on the intensity of dishonesty. We demonstrate dishonesty in light of monetary values and two frames of social norm, revealing critical implications to the field of behavioral economics and business ethics. (shrink)

This study explores the bright side of Monetary Intelligence and behavioral economics, frames money attitude in the context of pay and life satisfaction, and controls money at the macro-level and micro-level. We theorize: Managers with low love of money motive but high stewardship behavior will have high subjective well-being: pay satisfaction and (...) quality of life. Data collected from 6586 managers in 32 cultures across six continents support our theory. Interestingly, GDP per capita is related to life satisfaction, but not to pay satisfaction. Individual income is related to both life and pay satisfaction. Neither GDP nor income is related to Happiness. Our theoretical model across three GDP groups offers new discoveries: In high GDP entities, “high income” not only reduces aspirations—“Rich, Motivator, and Power,” but also promotes stewardship behavior—“Budget, Give/Donate, and Contribute” and appreciation of “Achievement.” After controlling income, we demonstrate the bright side of Monetary Intelligence: Low love of money motive but high stewardship behavior define Monetary Intelligence. “Good apples enjoy good quality of life in good barrels.” This notion adds another explanation to managers’ low magnitude of dishonesty in entities with high Corruption Perceptions Index. In low GDP entities, high income is related to poor Budgeting skills and escalated Happiness. These managers experience equal satisfaction with pay and life. We add a new vocabulary to the conversation of monetary intelligence, income, GDP, happiness, subjective well-being, good and bad apples and barrels, corruption, and behavioral ethics. (shrink)

Corruption involves greed, money, and risky decision-making. We explore the love of money, pay satisfaction, probability of risk, and dishonesty across cultures. Avaricious monetary aspiration breeds unethicality. Prospect theory frames decisions in the gains-losses domain and high-low probability. Pay dissatisfaction (in the losses domain) incites dishonesty in the name of justice at the individual level. The Corruption Perceptions Index, CPI, signals a high-low probability of getting caught for dishonesty at the country level. We theorize that decision-makers adopt avaricious love-of-money aspiration (...) as a lens and frame dishonesty in the gains-losses domain (pay satisfaction-dissatisfaction, Level 1) and high-low probability (CPI, Level 2) to maximize expected utility and ultimate serenity. We challenge the myth: Pay satisfaction mitigates dishonesty across nations consistently. Based on 6500 managers in 32 countries, our cross-level three-dimensional visualization offers the following discoveries. Under high aspiration conditions, pay dissatisfaction excites the highest- (third-highest) avaricious justice-seeking dishonesty in high (medium) CPI nations, supporting the certainty effect. However, pay satisfaction provokes the second-highest avaricious opportunity-seizing dishonesty in low CPI entities, sustaining the possibility effect—maximizing expected utility. Under low aspiration conditions, high pay satisfaction consistently leads to low dishonesty, demonstrating risk aversion—achieving ultimate serenity. We expand prospect theory from a micro and individual-level theory to a cross-level theory of monetary wisdom across 32 nations. We enhance the S-shaped Curve to three 3-D corruption surfaces across three levels of the global economic pyramid, providing novel insights into behavioral economics, business ethics, the environment, and responsibility. El objetivo es conocer las circunstancias y tratamiento judicial de asesinatos por violencia de género. Se plantea el diagnóstico forense de muerte, se exponen resultados de la investigación realizada por Genovés et al. en 2018 sobre150 casos de muerte por violencia de género en Andalucía, se plantea un posible patrón de conducta basado en la teoría de los pensamientos obsesivos y rumia silenciosa. Los resultados muestran una violencia anunciada, sin trastornos mentales graves, los asesinatos se mantienen constantes en el tiempo, (...) la violencia empleada suele ser excesiva en comparación con otras muertes, el instrumento más usado es arma blanca, el agresor no se esconde, no suele arrepentirse, la calificación ha sido de asesinato en un 79%, concurriendo alevosía en un 91% de los casos, la indefensión de la víctima es buscada y utilizada por el agresor, el domicilio familiar es el lugar donde más asesinatos se producen. Se aprecia una evolución positiva en la aplicación del derecho. Es necesaria la perspectiva de género en la Justicia. (shrink)

In cybersecurity, there is a call for adaptive, accurate and efficient procedures to identifying performance shortcomings and security breaches. The increasing complexity of both Internet services and traffic determines a scenario that in many cases impedes the proper deployment of intrusion detection and prevention systems. Although it is a common practice to monitor network and applications activity, there is not a general methodology to codify and interpret the recorded events. Moreover, this lack of methodology somehow erodes the possibility of diagnosing (...) whether event detection and recording is adequately performed. As a result, there is an urge to construct general codification and classification procedures to be applied on any type of security event in any activity log. This work is focused on defining such a method using the so-called normalized compression distance (NCD). NCD is parameter-free and can be applied to determine the distance between events expressed using strings. As a first step in the concretion of a methodology for the integral interpretation of security events, this work is devoted to the characterization of web logs. On the grounds of the NCD, we propose an anomaly-based procedure for identifying web attacks from web logs. Given a web query as stored in a security log, a NCD-based feature vector is created and classified using a support vector machine. The method is tested using the CSIC-2010 data set, and the results are analyzed with respect to similar proposals. (shrink)

Aranguren sobre «puede» y «debe» en ética, aquí se plantea el significado de los principios de ética en la situación de retroceso democrático del siglo XXI. Ha sido analizada por la filosofía y la teoría política recientes. En los años sesenta, las críticas de D. Sternberger al modelo de polis, de política cívica en las obras de H. Arendt, se apoyaban en la imagen de la ciudad hundida. Pero las preguntas sobre (...) el alcance del realismo («puede») y el lugar de los principios («debe») siguen abiertas. ¿Ultra posse nemo obligatur? Aquella imagen de la polis puede ser reemplazada por otra algo distinta, la ciudad sumergida. Se encuentra en la literatura, sería también la metáfora de la necesaria reconstrucción de las políticas democráticas, con el «deber ser» como núcleo de la cultura cívica. Los principios éticos y, en especial, justicia como equidad será aquí la referencia en dos situaciones: (1) la política de salud pública, (2) los procesos de paz. En conclusión, el marco normativo cuenta o ha de contar, tanto en la paz como en la guerra. Decir «nunca más» es también una forma de recordar el papel crucial de los principios. (shrink)

La presente propuesta pretende dar cuenta del estudio de un caso donde se implementa un modelo experiencial basado en proyectos centrado en la asignatura: Producción de programas informativos en televisión. En consecuencia, tras la evaluación de esta propuesta formativa donde han participado más de doscientos cincuenta alumnos se (...) ha determinado que podría resultar una alternativa válida y trascendente para aplicarse en futuros cursos académicos. Como tesis de este artículo se plantea que la filosofía heideggeriana posibilita meditar en torno a la experiencia del reconocimiento del otro. Después de poner en cuestión algunas de las críticas dirigidas a Heidegger debido a su énfasis sobre el ámbito ontológico, se aborda el sentido del concepto de reconocimiento y su nexo con la noción de cercanía, para culminar en la identificación de la cercanía con el lenguaje. Esta identificación dará a la experiencia del reconocimiento un carácter particular (óntico- (...) ontológico), que permitirá comprender su “esencia”. La pregunta por la condición de posibilidad del reconocimiento conducirá al concepto de “pre-sentimiento”, no abordado por Heidegger pero posibilitado por su filosofar. Se concluye con la concepción del reconocimiento como condición estructural de la existencia humana. (shrink)

The uncritical appropriation of Eurocentric ethical paradigms can be detrimental to disenfranchised communities of color, especially the Hispanic community. This essay argues for an ethical methodology rooted in the hopelessness found within Latino/a marginalized communities. Advocating for an ethics para joder disrupts a normative Eurocentric ethical discourse that at times normalizes and legitimizes "empire." The essay begins by casting a critical gaze at the academy before analyzing the overall social context in which Hispanics find themselves.

Este artículo pretende exponer la complejidad del tema del estatuto del embrión en la fase de preimplantación. Para ello, se exponen de modo sistemático las diferentes razones que sustentan tanto la postura de la anidación como de la fecundación. Estas razones son tan fundantes que obligan a seguir manteniendo un diálogo abierto y no sustentar posturas cerradas.

El presente volumen está dedicado a la reflexión filosófica inter-cultural y, por ello, con nombre propio, a Raúl Fornet-Betancourt, figura prominente en este ámbito del pensar contemporáneo en Latinoamérica, El Caribe y Europa. Es en gran parte gracias al Prof. Fornet-Betancourt que la voz de los pueblos hispanohablantes de América es escuchada actualmente como expresión de un modo de pensar propio que, sin abandonar el profundo y amplio conocimiento de la tradición, asume nuevas problemáticas y objetos de reflexión, como también (...) permanentes y antiguos dilemas de la existencia hu-mana, desde una perspectiva de diálogo entre culturas. Esta perspec-tiva, abierta a la sensibilidad creativa de la rica mixtura afrodescen-diente, indígena y europea que configura el amplio ethos espiritual de Centroamérica, el Caribe y América Latina, habla al mundo desde lo propio que no se encierra en sus límites, sino que, por el contrario, se atreve en igualdad de condiciones a entrar en diálogo con otras culturas en torno a lo sido del mundo, del hoy que nos compete y de lo que adviene desde ya en el presente. Este es el legado que ya desde hace algunos años construye el Prof. Fornet-Betancourt, y que sirve de marco de referencia a la mayoría de artículos que conforman este número especial de nuestra revista en su honor. Este artículo aborda la ‘tierra natal’ como expresión de la pregunta heideggeriana por ‘el sentido de lo que es’. Técnica y civilización mundial son consideradas aquí como tendencias hacia la homogenización de la experiencia humana y como pérdida de ‘lo propio’ representado en la tierra natal, lo que conduce a la disolución de la diferencia y de la interpelación ética del Otro. La filosofía de Heidegger, por el contrario, permite afirmar la tierra natal como apertura a la interpelación del ‘otro’.

En este trabajo argumentaré primero que para entender las relaciones entre el populismo la democratización y el autoritarismo hay que partir de las experiencias latinoamericanas donde los populismos han retado al poder y han gobernado desde los años 40. Los científicos sociales latinoamericanos teorizaron y debatieron sobre el populismo desde que Gino Germani escribió en los años 50 sobre el peronismo y los investigadores europeos y norteamericanos deberían tomar en serio la larga y compleja bibliografía latinoamericana sobre el tema. Además, (...) Latinoamérica es la región en la que se han dado los populismos más benignos e incluyentes, mientras que las caras más autoritarias del populismo de derecha se han manifestado en los Estados Unidos y en algunos países de Europa. Mi segundo argumento es que hay que diferenciar las críticas populistas al poder constituido que señalan los déficits de participación y representación de las democracias de sus soluciones que reducen la complejidad de la democracia, la sociedad civil y la esfera pública a la lucha entre dos campos antagónicos. Mi tercer argumento es que hay que diferenciar entre inclusión y democratización. Los populismos latinoamericanos, desde el peronismo hasta el chavismo, han incluido políticamente, étnicamente y socio-económicamente a los sectores marginados. Sin embargo a su vez han atentado en contra del pluralismo, han manufacturado enemigos y han cerrado espacios a la oposición. Mi cuarto argumento es que si bien los populismos comparten una lógica política no todos son iguales. Algunos politizan las exclusiones alrededor del eje mercado-estado, otros alrededor de temas culturales como la identidad del pueblo y la nación. Unos usan criterios étnicos para construir al pueblo, mientras que otros politizan las exclusiones socioeconómicas. (shrink)

Socratitos es un pensador irreverente cuyas preocupaciones en pocas pero abigarradas materias, entre ellas, la insospechable lógica del derecho, simulan todo el tiempo inclinarse más al humor que a la razón. En este diálogo falso, Arturo Zaldívar, Presidente de la Suprema Corte de Justicia de la Nación, discute con aquel poco original personaje sobre cuál es la verdad acerca del número de votos emitidos por la invalidez de los artículos 4, fracción VI, y 26 de la Ley de la Industria (...) Eléctrica, en la acción de inconstitucionalidad 64/2021, resuelta por la Suprema Corte el 7 de abril de 2022. Luego de que en apariencia quedaran refutados por Socratitos, uno a uno, los argumentos del Ministro para justificar por qué no se alcanzó, a favor de la invalidez, la mayoría calificada de ocho votos —como reclamaron diferentes académicos y actores políticos— sino solo la simple de siete votos, la verdad procesal termina de cualquier forma por imponerse, quedando, así, depuesta la pregunta acerca de la verdad material, al estilo de los diálogos platónicos de juventud que el autor pretende emular. Este trabajo parte de la concepción de la narrativa transmedia por parte de Henry Jenkins como el arte de making worlds, de construir mundos de ficción, para extender los fundamentos teóricos de esta definición al género documental. Si Bill Nichols indica que este género de no ficción tiene per se un gran poder persuasivo -por la naturaleza icónica de sus imágenes y sonidos y por el efecto psicológico de verosimilitud que suscita en el público-, aquí defendemos que este carácter se (...) potencia por medio de la narrativa transmedia. La inmersión, la extrabilidad y la performatividad de este tipo de narrativa lleva a la participación activa del usuario en el mundo transmedia, que coincide con su propio mundo, el real. Por esa razón numerosos proyectos activistas han visto en el documental transmedia una oportunidad tanto para el ejercicio del pensamiento crítico como para el cambio social. (shrink)

Several studies have examined victim blaming in rape scenarios. However, there is limited research on the analysis of the perception of blame when two or more perpetrators are involved. The present article explores the perception of blame in cases involving rape based on the level of resistance shown by the victim and the presence of one or more perpetrators. A study was carried out involving 351 university students who responded to a survey after reading a hypothetical assault scenario. Six situations (...) were established where the victim showed either low or high resistance, depending on whether the resistance was verbal or physical and verbal, and in the presence of one or two male perpetrators. It is expected that perpetrators are more culpable when acting in groups and that less resistance from the victim leads to greater attribution of blame. The results confirm that more blame is attributed to the perpetrators when they act in groups than when they act alone. Likewise, women consider the victim generally exerts greater resistance and this variable influences the attribution of greater blame. (shrink)

The book carefully details the settler- colonial ideology and logic of elimination that permeated US territorial expansion over the Northwest Territories at the end of the eighteen and the first decades of the nineteenth centuries. Seeing Red thoroughly examines the complex context of dispossession by the US colonial power, centering on Anishinaabeg communities, the “mix- race” population, and the different Indigenous people inhabiting this region. However, the book focuses on what the author names “unthinkable history,” following Michel- Rolph Trouillot’s argument that this region, and the whole continent, was conceived as an unsettled territory instead of belonging to many Indigenous peoples. Thus, the text explores Indigenous and mixed- raced communities’ political imaginaries and imagined futures to retain autonomy and territory.Author Michael John Witgen is a citizen of the Red Cliff Band of Lake Superior Ojibwe and a professor in the Department of History and the Center for the Study of Ethnicity and Race at Columbia University. His research centers on the complex relations between Indigenous people and settler colonizers in the Great Lakes and the Northwest Territories. Seeing Red expands his previous analysis of race, ethnicity, and citizenship intersections, bringing to the fore Indigenous people’s history to rethink the statemaking process in the United States.This book’s pages show that theft lies at the foundation of wealth transfer from Indigenous territories to the United States government and white citizens. The white settler ideology, based on a “doctrine of discovery,” established a stark division between the civilized and uncivilized to rationalize, among other things, the theft of Indigenous people. This is a central argument of the book that signals how the civili zation project underpinning the territorial expansion of the United States was based on the transformation of commons into private property. Indigenous land became critical in the “political economy of plunder” advanced by the state and the meaning of “native” as a racial categorization of exclusion. Chapter 1 explores this economy of plunder by detailing the advancement of the settler frontier through different [End Page 139] mechanisms, such as the treaty policy— subsequently violated by the state— and territory surveying to make land legible for the state and cheap for settlers. It is worth mentioning that the book contains historical and thematic maps that visually represent the ideology of wilderness behind the colonization project and evidence of the territorial extent of dispossession suffered by Indigenous communities. However, this crusade to dispossess Indigenous peoples from their territory also rested on the national mythology that strengthened the trope of Indigenous vanishing. The author shows how during the years of the study, the Indigenous population was not vanishing but immersed in an intricate social world and transregional trade networks. Chapter 2 explores such context, following the story of an Ojibwe man to evidence the context in which settlers and federal officials relied on Indigenous customs to profit from the fur trade while using ties with communities to further land cessions.Mix- race families played a crucial role in expanding the settler frontier through treaty negotiations but remained marginalized as they identified themselves as both Natives and US citizens. Chapter 3 examines the significance of mixed- raced families, particularly women, in establishing and expanding missions’ schools that relied on their domestic and linguistic labor. After the Maastricht and Amsterdam Conferences the European Union can no longer be conceived as an intergovernmental arrangement: It is a polity founded on an “overlapping consensus.” Consequently, to reconstruct the relations between national and Community law, legal monism does not work, neither in its statist, nor in its international version: Legal pluralism is needed, not in a sociological‐descriptive sense, but as a normative criterion by which a judge (and a citizen) must refer to many and various sources of law (...) to settle a dispute. Legal pluralism, however, can operate only under a rule of recognition: a common normative framework within which a reasonable number of sources can be handled. What Europe needs, therefore, is an interactionist constitution, which should emerge through an “open‐ended”discursive process. (shrink)

This article provides an assessment of the merits of recent theories of legal reasoning. After a quick historical aperçu a number of models of legal argumentation are presented and discussed, with an eye to their mutual connection. An initial conclusion is that universalizability and discursivity are the common features of those models. The focal question dealt with, however, is that of the impact of the argumentative paradigms of adjudication on the very concept of law. Here the contention is that an (...) argumentative style of reasoning contributes to rendering the structure of the law itself and its operations argumentative as well. By so doing the latter are—so to say—civilized and made less truculent. They will thus be able to develop more in conformity with a democratic form of life. (shrink)
